Booking Terms & Conditions
Reservations for accommodation by guests (the Guest) are accepted by (Luxury Holiday Lettings) on behalf of the Property Owners (Vicki and Adam Rider – the Property Owners).
The Agreement: The rental agreement is between the Guest and the Property Owners. The contract is deemed to have been made once the Guest has paid a deposit and the Property Owners have dispatched a confirmation of booking. The Guest must be over 18 years of age at the time of booking.
Booking: The Guest who makes the booking is deemed to have agreed to these Terms and Conditions will be responsible for all persons included in the booking and should ensure that they are all aware of these Terms & Conditions. The Property Owner reserves the right to decline any booking or refuse to hand over a key to any person who has not complied with these Terms & Conditions.
Payment: For bookings made more than 6 weeks before arrival, a deposit (part payment) of 25% of the total cost of the holiday, is required. The balance is due 6 weeks before the holiday commences. For bookings made less than 6 weeks before arrival, the total amount is payable in full on booking.
The Guest agrees to pay the balance of the payment SIX (6) weeks before the holiday is due to start. Email reminders are sent, but delivery cannot be guaranteed. Where a guest fails to pay their balance by the due date the booking may be cancelled and the deposit retained.
Cleaning: The Guest is responsible for leaving the accommodation in good order and in a clean condition; otherwise an additional cleaning charge may be levied. Please note that the convention of Luxury Holiday Lettings is that are expected to leave the property in a similar state to which they find it (reasonable cleaning excepted). Please abide by this convention.
Number of People using the Holiday Accommodation: The Property Owners permit the Guest and members of the guest’s party (but no one else) to occupy the property for holiday purposes only. The Guest must declare the correct number of additional guests during booking and, if this changes, must inform the Property Owner before the rental commences of any change. No more than the maximum number of persons stated on the website may occupy a property unless by prior written agreement with the Property Owner. Extra charges may be applicable if the number of guests differs from the number on the booking. The maximum number of occupants includes all children aged over 2 years.
Arrival/Departure: The properties (unless otherwise stated in the property details) are available for occupation from 2pm for Brierley The Garden Flat, from 3pm for No.3 By The Sea, 3pm for 147 By The Sea and from 4pm for 357 By The Sea on the first day of the holiday (the arrival date) and must be vacated by 10.30 am on the last day of the holiday (the departure date). For Guests staying at 357 By The Sea the departure time is 11am. Earlier Check in’s and later check outs are sometimes available depending on the cleaning schedule but must be requested in advance of the Guest’s arrival and must be requested by email.
Cancellation or Changes by the Guest: Once the holiday is booked the Guest has entered into a binding contract. If the Guest cancels, for whatever reason (including medical and weather related) then no refund of the deposit will be due, and within 6 weeks of the holiday no refund of the full balance is due. A holiday cancellation insurance / protection plan should be taken out by the Guest to cover forced cancellations.
Cancellations: Cancellations must be notified in writing (including by email) to the Property Owner immediately. The Property Owner will endeavour to re-let the property and if successful may at their discretion allow the guest to transfer to alternate dates. Holiday dates may be changed providing the property is available for the new dates and the owner is agreeable to the change.
Holiday Insurance: We recommend and expect that the guest will have or will take out their own holiday insurance policy (which includes cancellation insurance covering sickness and unavoidable reasons for cancellation) prior to their stay.
Pets: No pets are allowed at any of Luxury Holiday Letting’s properties.
Guest Responsibility: The supervision of children, babies and any adults requiring care remains the responsibility of the guest at all times.The Property Owners maintain a very high standard of cleanliness and comfort at all times. The Guest undertakes to leave the properties, their fixtures, furniture, accessories, appliances, equipment and all soft furnishings in the same good condition as they were found.
General Request: We would prefer that Guests do NOT move items around the property during their stay. However, if Guests should move any items during their stay we would kindly request that Guests put these items back to where they were at the beginning of the rental period. The Property Owners kindly ask that the Property Owners books are not removed or swapped at any time and that any Guests books are not left behind at the end of the Guests stay.
Items left at the Property: Guests should take all their own personal items with them on departure. If the Guest leaves any items at the property the property owner will check if the Guest would like the item/s returned to them. The Property Owner will endeavour to return items left behind to the Guest as soon as is convenient and as long as it it possible and practical to do so. The Property Owner will charge the Guest to return the items. The cost of returning the item will depend on the size and weight of the item. Food and drink left behind will not be returned to the Guest, these will be disposed of by the Property Owner.
Damage, Loss, Theft: Guests agree to inform the Property Owners of any damage or loss however caused, that may be incurred during occupation. Guests should not remove any item from the property. The Property Owner may ask for reasonable replacement costs if items are lost or missing upon departure.
Nuisance: Guests should not cause nuisance or annoyance to occupants of any nearby property.
If, in the opinion of the Property Owner, any person is not suitable to continue their occupation of the property because of unreasonable behaviour, damage or nuisance to other parties, the contract may be treated by the Property Owner as discharged and they may repossess the property immediately. The guest will remain liable for the whole cost of rental and no refund shall be due.
Access: Guests must allow reasonable access to the property by the Property Owner for maintenance given reasonable notice.
Property Descriptions: Property descriptions and all details both written and verbal are given in good faith and believed to be correct, but interpretation thereof can be subjective and as such their accuracy cannot be guaranteed. Property details may vary over time from photographs and descriptions on the websites.
Changes to the Website: The property Owners website may be updated from time to time, and the content may change at any time. However, please note that any of the content on the site may be out of date at any given time, and the property Owners are under no obligation to update it. Therefore the Property Owners do not guarantee that the website, or any content on it, will be free from errors or omissions. Therefore although the Property Owners make reasonable efforts to update the information on the bebytheseaside site, they make no representations, warranties or guarantees, whether express or implied that the content on the site is accurate, complete or up-to-date
Use of, or inability to use, our site;
Damage, loss, theft, injury or any damage suffered whilst at a property; Loss or theft due to online fraud outside of our control;
Failure of the property to meet all legislative requirements (since this is the responsibility of the property owners);
Use of or reliance on any content displayed on our site;
For any temporary defect or stoppage in the supply of Electricity, Gas, Oil, Water, Sky or Broadband;
For any death or injury to the Guest or people under his or her responsibility;
For any loss or theft of property belonging to the Guest or other people under his or her responsibility;
For any loss, damage or injury which is a result of adverse weather conditions, riot, war strikes or other matters beyond the control of the owner; or
For any loss, damage or inconvenience caused to or suffered by the Guest.
Business Users: Business users, please note that in particular, the Property Owners will not be liable for:
loss of profits, sales, business, or revenue;
loss of anticipated savings;
loss of business opportunity, goodwill or reputation; or
any indirect or consequential loss or damage.
Vehicles: All vehicles are left at the owner’s risk.
Services: All services servicing the properties i.e. Electric, Gas, Oil, Water and broadband are included within the price.
Links to the Website: Where the Property Owners site contains links to other sites and resources provided by third parties, these links are provided for your information only, the property Owners have no control over the contents of those sites or resources
Complaints: No complaints can be considered unless notified during the guest’s stay in the property and it is therefore the Guests responsibility to inform the Property Owner at the earliest possible opportunity of any problem.Complaints received after departure cannot be accepted as the Property Owner thereby has no opportunity to resolve the complaint at the time.
Liability: The Property Owner cannot accept responsibility for any material loss, damage, additional expense or inconvenience directly or indirectly caused by or arising out of the property, its plumbing, gas, electrical services or exceptional weather.
No responsibility is accepted for loss or damage of Guest property, vehicles or vehicle contents belonging to the guest or any member of the party during their occupancy.
The maximum liability accepted by the will be the total cost of the holiday as paid by the guest. No other expenses such as travelling costs or alternative accommodation will be accepted.
Cancellation by Owners: The Property Owner reserves the right to refuse any booking and to cancel any bookings already made if the property is unavailable (eg through fire, flood, etc) for any reason whatsoever, subject to a full refund of all monies paid (but no further liability). Neither the Property Owner shall be under any other liability if such cancellation occurs. Note: in the unlikely event of a cancellation the Property Owner will make every possible effort to secure alternative accommodation if required.
No Smoking: Luxury Holiday Lettings has a No Smoking policy within all its properties.
Force Majeure: The Property Owner cannot accept responsibility or liability for any alterations, delay or cancellation or any other loss or damage caused by war, civil strife, terrorist action, industrial disputes, fire, sickness, bad weather, epidemics, acts of any government or public authority, or any other event outside our control.
Waiver: The failure of the Property Owner to enforce or exercise, at any time or for any period of time, any term of, or any right pursuant to this agreement does not constitute and shall not be construed as a waiver of such term or right.
Miscellaneous: The Guest agrees that the contract with the Property Owner is made at the Property Owners premises and that any proceedings between the parties shall be conducted in the County Court nearest to the owner.
